Let the facts do the talking

I've followed the Aarushi murder case over the last few years and have been intrigued by the way the media has covered this case. Mr. Sen's superbly written book cuts through the clutter and presents the facts of the case. Where appropriate, he isn't shy to voice his opinion. But for the most part he simply lets the facts do the taking.
In books such as these, journalists tend to rely heavily on anonymous sources, writing for example: "a source close to the investigation" or "a person with knowledge about the case", etc. But Mr. Sen, to his great credit, has not gone down this path. He has diligently tracked down all the sources and has had in-depth on-the-record conversations with them. His due diligence shines throughout the book and adds to his credibility. There are some bombshell revelations from these conversations. For example, forensic expert Mr. Dahiya, who was responsible for recreating the crime scene and who's testimony was key to the guilty verdict, was completely misled by the CBI investigator Mr. Kaul. Mr. Dahiya was unaware that a key piece of evidence - a pillow case with blood of Mr. Hemraj - was not recovered from Aarushi's room. This finding was deliberately not shared by Mr. Kaul, who preferred to not let facts get in the way of a good story.
Mr. Sen's book is full of such revelations, including the fact that the judge in the case decided to write his verdict even before he heard closing arguments from the defense because he wanted to wrap up the case before his retirement. The book is a serious indictment on India's law and order institutions. Mr Sen's superb reporting spares no one: the blundering police force, the corruption in the CBI, the sensationalism of the media, the culture of backwardness and hypocrisy, the incompetent judicial system (especially at the lower levels), etc.
While one may not expect high standards from the media, it was shocking to read that the pubic prosecutor closed the state's case by slandering the accused of watching pornography all night after murdering their daughter. According to Mr. Sen, no internet records were obtained by the state and there is no proof of what contents were accessed. Yet the prosecutor slandered the accused, knowing that the mention of pornography will shock the public.
Reading the mishandling of this case reminded me of the case of Alfred Dryfus - a Jew - and a captain in the French army who was falsely accused of selling military secrets to Prussia. Although the evidence was weak, he was court-martialed, convicted for treason, and sentenced to life. He remained there for years, despite clear evidence that another man was guilty. The conspiracy against Dreyfus involved forged evidence and corrupt officers. He was treated unfairly because he was a Jew. The accused in the Aarushi double murder case got a raw deal because of incompetence, corruption and lack of objectivity. They were scandalized by the media and treated unfairly by the system as a result. �mile Zola famously took up the case of Alfred Dryfus, seeking justice and bringing to light the issues of the day such as anti-Semitism in France. Mr. Sen has written a terrific book that also brings to light several issues of today. It remains to be seen whether the status quo will change.

Timely book on the most unfortunate case

I thank the author, Avirook Sen for this book and the effort he has invested in detailed research. Since the release of this book, the Noida Double Murder topic is back in discussion. There have been reviews and debates. People who were convinced before on parent's innocence are convinced even more now and those who accepted them guilty have branded Avirook as pro-Talwar and biased.
I have to admit that, if not for Avirook's report during the trial, we would have never seen all the facts related to the case. The article series on mumbaimirror was useful to understand the details, lies, botched testimonies and malafide intent of the CBI. The book has put many of my doubts to rest with extended information like interviews, narco analysis details etc. I was hoping for an interview with Arun Kumar and was happy to see the same in the book. He is the only credible and accountable person in this case. But, I am sad to say that few things are really the way I had guessed. I had guessed that KK Goutham and post-mortem doctors improved their statements for some hidden benefits, sacrificing Talwars. Also, the book brought back memories of "Usha Thakur" and exposed her lies. She appeared in few TV debates related to this case claiming Hemraj had contacted her for help few days before his death and she read the news of the murders when she was in Bangalore, not in Noida. But on 17th May what was she doing in the crime scene, when the Talwars were not at home?
I read the book many a times by now and feeling sad/angry/content all at the same time. Content, because most of my doubts are clarified.
In 2013, CBI gave a clean chit to UP minister accused in a murder case after lie detector tests. In 2014, CBI (again with Mr Kaul in lead) gave clean chit to initially arrested people in badaun case after lie detector tests. But why not Talwars? Hundreds of such questions have haunted me. The most saddening part of all is the casual ignorance by Arun Kumar's team in reading the report from CDFC which caused a huge damage to Talwars's case. I have seen him in few TV debates when he was the ADGP of UP and he is known for his upright and straightforward image and is much celebrated for his work in building STF. I was surprised at what went wrong with his team in Noida double murder case. Nevertheless, It is heartening to know that he accepts he is not perfect and was open for further investigations. Was it Talwar's fate to have 2 CBI teams of extreme nature? So near yet so far from truth!! In my opinion, the first CBI team followed a more credible path in investigation. Though Arun Kumar was silent till his interview to Avirook for this book, it is interesting to note that in mid 2013, while the trial was still going on, Kumar had retweeted Shoma Chowdhury's Tehelka article "Framed" http://www.tehelka.com/framed-the-aarushi-hemraj-murder-case-an-investigation/. Probably that was his way of providing his muted comments. If the second CBI team had the same "straight" approach, the results would have been different.
As the author says, it is not for us to decide who the killer is. Since the trial is over, the question is did parents kill Aarushi and Hemraj? Even before i read the book, going through details of crime scene analysis, closure report and Avirook's articles on the mumbai mirror, i had framed my opinions that Talwars cannot be blamed for the murders. A close look at the closure report and trial details highlights following points.
a) The closure report doesn't say that the maid tried to open the front door, before asking for the keys. Here the stress is on the fact that mother was all fine when maid rang the doorbell and in few minutes she was crying. It is not about Talwars pretending that they were locked in their own home. I believe that when the case was forced to undergo trial, new issues were created to damn the parents.
b) The details provided by Dr Naresh Raj in trial is not there at all in the closure report. There was no need for this as everyone in the CBI team thought the case is closed. But, at the trial level, new nonsensical points were added. In the judgement, the point "He has also admitted that Hemraj was average built but he has no knowledge as to whether his willy was turgid." is a direct reference to Naresh Raj's testimony.
c) Enough foundation was already laid in the closure report to victimize Talwars. CBI did not expect the case might go to trial. More damning things were created at the trial level to ensure that they have no way to escape.
d) The closure report says a wet circular patch was found on the bedsheet below the child's pelvic area. Let's assume the photo was taken around 7-8 AM in the morning. That is about 6-7 hours after the possible death. Won't moisture dry off by that time, that too on a summer night? How come photos show the wet circular patch? Try spilling some water on a bedsheet and watch out. In couple of hours you will not see any traces of wetness. Did the suspects use buckets of water, so that the mattress was soaked in water and the wetness patches were visible in the photos? Why is that this fact was not noticed by other teams for 1.5 years? I feel the investigation should start all over again to check if there were any manipulations of the photos of the crime scene. It is interesting that the crime scene photos were leaked around the time closure report was filed. Check the story http://indiatoday.intoday.in/story/the+untold+story/1/126593.html. The author seem to have accepted all the points in closure report, without questioning. The article talks about phone loop created between Dinesh, his friend and KK Gowtham. But why did Gowtham take 2 years to disclose this? What about credibility of Dr Dohare's "Subjective" findings about the child's private parts? Has he contacted some medical expert to verify these findings? The least author could have done is ask questions. Is this fair journalism? This article is an example of Talwar's concern : "Media was CBIs B team".
e) The Closure report brought in the facts of the router activity for the first time. The router was switched off at 3.43 AM and again was switched on at 6.01 AM indicating that the parents were active on internet after murders. The router being on and active doesn't mean someone was using the net. Most of us do not switch off the router at all for days together. What if the switch for the bedroom light and the router were close to each other? Isn't there a possibility that the servants might have turned off all the switches before they left? [Raj Kumar in his narco says that he left Talwar's house around 4 o clock] They might have tried to put off the light and turned off all the switches. Possibly the next day also people (including Rajesh Talwar at 6:01 in the morning) might have turned the switch on/off in confusion for the light switch, resulting in the inexplicable router on/off activity. OR Isn't there a possibility that the wire connecting the router to the switch board was defective with loose contact and might have resulted in router on/off? How can we rule out such possibilities? The problem is each circumstance in this case has gaps and alternative narratives are possible.
d) In fact judge has used router activity as one fact in the chain of circumstances, to blame that talwars were using the internet. So what makes him arrive at this conclusion? The airtel billing details suggest data exchange of 46 kilo bytes around 2 AM in the night and 3 Kilo Bytes at 6 AM in the morning.Where is the list of sites they have supposedly browsed with such a low data usage? It is a known fact that even when no device is connected to the router, there will be some data exchange between the router and ISP.
Mr Kaul and his investigation is unbelievable. But the question is how is that court just accepted whatever Kaul presented? I had my own opinions about why second team worked the way it did, knowing the level of corruption in our country. But this is not about several lakh crore telecom bandwidth or coal mines. It was about death of an innocent 14 year old child and her reputation!!. But in spite of all the loop holes, why did court come to the conclusion that Talwar's guilt is established beyond reasonable doubt? We need to think a lot on this.
More than corrupt bureaucracy and the media that sensationalized every aspect of this case, the painful part is that the common public that formed random opinions based on the salacious points fed by the CBI and the media. Few examples on how media can derail the perceptions of public.
1) A book is written in kannada Enaytu Magale (Arushi Murder)[Translation : "What happened dear daughter?"] by a popular author who runs a tabloid in local language, in which he has hurriedly written some story supporting CBI point of view. The author goes to the extreme extent to guess that possibly talwars were nude (as no blood of hemraj was found on their clothes) while they shifted Hemraj's body to the terrace and probably they used internet to research on how to kill etc. He beats Mr Kaul in the narration of the so called affair with graphic details and imaginations exposing his perverse mindset. I read this book out of curiosity and tried to check what research the author has done. No interviews with concerned parties, no access to the documents but the book was written!!. The worrying factor is, what about people who read this book written by a popular author and believe the information as facts? Did he contact Aarushi's parents to check his story? I don't think so.
2) While reading through articles related to this case i came across this blog, supposedly run by a retired doctor. https://ushapadiyar.wordpress.com/2014/01/09/who-may-have-killed-aarushi-talwar-part-ii/. The analysis by this lady is hilarious, full of imaginations and in the comments section, we can see the author's derogatory comments about Talwar family and especially about Aarushi's mom. Why should one go to such a low level about getting judgmental about another human being? I have no comments or opinions about this blog.
Overall the book has covered 90% of everything related to this case, with verified facts. Following few points are not clarified.
The judgement states that the bedsheet on Aarushi's bed before murder as seen in the photograph taken in her new digital camera and after murder are different.The judge hence says that parents might have changed this. This issue is not clarified in the book. My doubt is how this was not pointed by the investigation teams before and only judge can spot this? Going by the reputation of the second team, we cannot rule out any photoshop miracles. Also this is a crucial point. Who changed the bed sheet in a matter of 2-3 hours? I remember KTS Tulsi was bringing up this point in the TV debates. After reading the book, i feel no point worrying about this. For a judge who did not consider that the pillow case was seized from Hemraj's room, who is OK with the testimony of a tutored witness, you cant expect anything better.
One perspective is missing in the book. Many experts who came on the media discussions, added their bit to the confusion. Noted Ex DGPs , ex CBI directors, supreme court lawyers and many others. I still can not forget the statement by ex UP policeman on 26 Nov 2013 that UP police's was the most professional investigation conducted, though they did it for only 14 days. It would have been good to see details of how they assessed this case. Avirook himself was on TimesNow's nation's concise keeper's show on 26 th Nov , but that show was awful due to ever enraged anchor and self declared human behavior expert Shobha De . It is important to analyse their point of views, because media created the major public bias, either pro or against talwars. Also tehelka and firstpost published few articles building positive perspective for the talwars. Did it make any impact at all? It seems the Talwars are again unfortunate here. The aarushi case verdictand resignation of Shoma of Tehelka happened in the same week. Shoma indeed had written a compelling story in support of the talwars, which got washed out due to the new credibility questions on her in handling Tehelka internal crisis. She tried to help Tarun Tejpal and also the Talwars was the impression. This can be seen in the comment section of that article and youtube videos. It would have been good to know the truth behind the media dynamics. Is it all TRPs or are there any noble intentions at all to prove their role as "powerful" pillar of democracy.
For common people like us, print and TV media is the only way to get to the details. The TV debates on 25th and 26th Nov 2013 were dense with details that we could not digest in couple of hours and make up our mind. I watched all the debates and many old ones since 2008 May many a times later from the respective archives and made few observations.
a) All ex bureaucrats were defending the UP Police and the CBI. It was really painful to see opinions of eminent officers like Ved Marvah, Vikram Singh, Karthikeyan, Maxwell Pereira, Joginder Singh, and R.K Raghavan. Mr Vikram Singh, who was the DGP of UP at the time when this incident happened, was happy that the CBI upheld what UP police had initially said. He doesn't seem to understand the fact that the Noida police did shoddy job and whenever he talks, it is evident he is covering the inefficiency of his force by blaming the grieving parents. It was evident that these officers were providing their opinion based on the closure report and the court testimonies. But how the evidences were created/manipulated was no ones worry. Being expert officers, they should be the ones questioning all insane "facts", like typographical error, modified postmortem reports, tutored witnesses. But all of them defended "Honour of the CBI". The most unfortunate statement of all was Mr Maxwell's,he said "It was a master move by the CBI to file the closure report". The closure report read like a charge sheet with baseless and concocted details and the trial was done without any extra evidences, but only with improved statements. Do these people do any homework before coming on national media?. Maxwell has appeared many times on debates related to this case and strongly defended the UP Police and the CBI and accused Talwars of delaying the trial. Is it just the urge to defend their fraternity or are there any other benefits? Note that he was the Senior officer of Delhi Police during 1984 sikh massacre and the trials of 30+ years are still pending. But, What was the hurry to punish parents, who seem innocent as there is no evidence against them except that they were in the next room? To give credits where it is due, Kiran Bedi made some sensible comments. She said "I would like to know what new has come since closure report. Koi naya kya hai?". I am with Maxwell Pereira on one point. He saidmore than police, media was responsible for sensationalizing this case. We, the people of India, have no trust in police anyway. At-least journalists should have done their job.
b) Most of the legal experts ( except Sushil Bajaj and Amba Salelkar), were defending the trial details and the verdict. Amba Salelkar on NDTV provided very good response on the judgement. I was expecting more analysis of the verdict from legal fraternity, but did not see much.
c) Family defended the parents.
d) People from media fraternity had divided opinions.
e) Most of the experts who were convinced that Talwars are the culprits were pointing only on their behavior. I did not see anything abnormal in their behavior. They looked like grieving parents in shock. Why so much of fuss about mother's attitude and behavior? Is it a crime for a female to be assertive and mentally strong? The societal stereotypes are strange. I am not talking about the UP police officers, with their khap mindset. Even eminent people like KTS Tulsi, Shoba De, Kamini Jaiswal etc were all commenting about Talwars behavior.
f) There are glaring errors in the details that are discussed in the debates about crime scene, wooden partition, missing golf club etc. The photos of crime scene are available online in which we can see that the pillow below Aarushi's head is soaked in blood. But still i have seen on television KTS Tulsi making points "The pillow on which her head is kept has no blood signs". This is just one of such errors. I feel frustrated. It is a pain to watch KTS Tulsi pass his arguments on this, in all the debates. I really wonder what benefit these people get in return for appearing in the debates? There must be something substantial, otherwise why would they appear repeatedly on NDTV, TimesNow, Headlines Today etc and talk nonsense? Think about the mental condition of talwar family, who are bombarded with same questions with errors and assumptions, again and again. I feel sorry for them.
Few more interviews with other journalists who reported from crime scene, bureaucrats, lawyers and judges and their perception then and now, would have been useful.
I am waiting to see "what next" on this case. I prefer to cling to one point made by Justice Sodhi in a debate on NDTV, "Circumstances do not lie. Any grey area goes in the benefit of accused". Interesting fact is that Justice Sodhi represented Monindhar Singh Pandher's (of Nithari fame) plea to overturn his death sentence that was awarded on the basis that "he must have known" the gory things his servant was doing. With that, I hope Talwars see better days in future. Being a parent of a child, I feel so much for what has been done to them.

I have edited this review multiple times to add all my thoughts. I started following this case from Nov 25 2013. My only reason to understand this case is, I could not accept the fact that parents killed Aarushi and Hemraj. As I started looking for more and more data I got completely involved in the research to understand more. Reading news articles, noting inconsistencies, watching the debates, researching on the experts who appeared in the debates, I tried to get a context of the society/country we live in. It started with Sonia Singh's interview of Nupur Talwar and there is an array of videos available in the media archives. Nidhi Razdhan, Ashutosh of IBN7, Shobha De, KTS Tulsi, Kamini Jaiswal, Namitha Bhandare, Arunima and Sagarika of CNNIBN with conflicting view points, Mihir Srivastava who strongly justifies CBI story and the only person to cover Hemraj's side of the story, Harinder Baweja who interviewed injured Rajesh Talwar, Arnab goswami who tries to sympathize with the servant boys flashing carefully leaked (lifted out of context) short footage of narco analysis of the boys, Rajdeep who tried to look unbiased by asking talwar's friends Masooma, not to be emotional, Justice R.S Sodhi, Pinaki Mishra, Shohini Ghosh, Shoma, Sushil Bajaj, Amba Salelkar, Pinky Anand, Sanjay Hegde, Naresh Yadav, R K Anand, D.R Karthikeyan, R K Raghavan, Maxwell Pierera, Joginder Singh, Ved Marwah, Kiran Bedi, Patrick French, and of course Vandana and Dinesh Talwar with their never ending support for Talwar family, Radhika Chedda, Shree Paradkar, the list is too long. Journalists, Social Activists, bureaucrats, lawyers, judges, friends and relatives of Talwars, my own family and friends, everyone had their point of view and there were my own. The reason for my interest in this case is, it could have happened to anyone of us.

A very thorough investigative journalism

I finished this book in 3 days, which is a measure of its readability and style because I am a slow reader and take weeks to finish most books. Sen has very well narrated the extremely complex story of the Aarushi murder case without getting the reader jumbled up in technical details or lost in multitude of characters. His socio-cultural and psychological analysis of the personalities involved in the case helps to understand why such a travesty of justice was possible. Hopelessly sad portrayal of the Indian legal and judicial system as it is, the book is a tribute to the few souls who tried to side with the truth. Sen is one of those rare souls in the profession of journalism today.
